Terms of Service

1. The Service

Clariturn is an analytics and advisory tool that analyses your own Instagram account data — retrieved through the official Meta/Instagram Graph API — and provides automated insights, audit scores, content-strategy recommendations, and planning tools. The Service is provided for informational and advisory purposes only.

How the analysis works (what we mean by "AI"). Our scores, insights, and recommendations are produced by automated statistical analysis and data-mining of your own metrics — established, transparent methods such as robust statistics (medians and recency-weighted typical values), cross-validated models, and rule- and pattern-based detection. Where we use the term "AI" in the Service or our marketing, we use it as a general, familiar label for this automated, data-driven analysis; the Service does not depend on a generative AI model to invent claims, and every recommendation is derived from, and traceable to, your own measured data. All output is advisory only — see §5.

Clariturn is an independent product and is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. or Instagram.

2. Eligibility & account

• You must be at least 16 years old (or the age of digital consent in your country) to use the Service.
• Full analytics require an Instagram Business or Creator account that you own and are authorized to connect.
• You are responsible for the accuracy of your registration details and for keeping your password and account secure.
• One Instagram account may be connected per Clariturn account.

3. Free trial, plans & billing

• Free trial. New accounts may start a 7-day free trial. No payment card is required to begin the trial. During our launch period, paid features may be provided free of charge.
• Subscription. After any trial or launch period, continued access to paid features requires a subscription, billed monthly or yearly as shown on our Pricing page at the time you subscribe.
• Renewal. Subscriptions renew automatically at the end of each billing period unless cancelled beforehand. You authorize us (and our payment provider) to charge your chosen payment method for each renewal.
• Taxes. Prices may be shown excluding or including VAT as indicated at checkout; applicable taxes are your responsibility where not included.
• Price changes. We may change prices; we will give reasonable advance notice, and changes take effect at your next renewal.

4. Cancellation & refunds

• You can cancel at any time from Settings; cancellation stops future renewals and your access continues until the end of the current paid period.
• Consumers in the EU have a statutory 14-day right of withdrawal for online purchases. By starting to use paid digital features during this period, you may be asked to acknowledge that you lose this right once the service has been fully provided.
• Except where required by law, payments already made are non-refundable for partial periods.

5. No guaranteed results

Clariturn does not guarantee any specific outcome — including follower growth, engagement, reach, or revenue. Recommendations are based on analysis of your own data and general content-strategy principles. Results depend on your content, consistency, audience, and market conditions.

6. Permitted use

• Analyse the performance of your own Instagram account
• Receive and act on content-strategy recommendations
• Plan your content calendar
• Export your own data

7. Prohibited use

You may not:

• Automate Instagram activity (likes, follows, unfollows, comments, DMs, story views)
• Scrape Instagram or access accounts you have not personally authorized
• Impersonate another person or account
• Violate Instagram's Terms of Use or Meta's Platform Policy
• Buy, sell, or solicit fake followers, likes, or comments
• Use the Service for any unlawful purpose, or to infringe others' rights
• Reverse engineer, resell, sublicense, or repackage the Service without our written permission
• Interfere with, overload, or attempt to gain unauthorized access to the Service

8. Intellectual property

The Service, including its software, design, branding, and the analytical methods we build, is owned by Clariturn and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose. You may use the insights and reports generated for your own account.

9. Your data & content

You retain all rights to your Instagram content and your own data. By using the Service you grant us the limited rights needed to process that data to provide the Service, as described in our Privacy Policy. You also agree that we may create and use anonymized, aggregated data as set out in §6 of that policy.

10. Your responsibility

You are solely responsible for ensuring that your use of Clariturn and your content strategy comply with Instagram's Terms of Use, applicable advertising and consumer-protection rules, and any other relevant laws. Clariturn is not responsible for actions you take based on recommendations provided by the Service.

11. Suspension & termination

We may suspend or terminate your access if you breach these Terms, use the Service in a prohibited way, or where required to protect other users, the platform, or comply with the law. You may stop using the Service and delete your account at any time. Provisions that by their nature should survive termination (e.g. IP, disclaimers, liability) will continue to apply.

12. Disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free, or that analytics data will be complete or fully accurate at all times (it depends on data Meta makes available through its API). Nothing in these Terms limits rights that cannot be limited under mandatory consumer law.

13. Limitation of liability

To the maximum extent permitted by law, Clariturn is not liable for indirect, incidental, or consequential damages, or for lost profits, revenue, data, or goodwill arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us for the Service in the 12 months before the event giving rise to the claim. These limits do not exclude liability that cannot be excluded by law (such as for death, personal injury, or intentional or grossly negligent conduct).

14. Governing law & disputes

These Terms are governed by the laws of the Czech Republic and applicable EU law, without regard to conflict-of-law rules. Mandatory consumer-protection rights of your country of residence remain unaffected. Disputes will be subject to the competent courts of the Czech Republic, unless mandatory law provides otherwise. EU consumers may also use the European Commission's Online Dispute Resolution platform.

15. Changes to these Terms

We may update these Terms from time to time. We will post the updated version here and, for material changes, notify you by email or in-app notice. Continued use after the effective date constitutes acceptance.
